No Fault Divorce – What do we know and how will it change the divorce landscape?
/Current divorce law means married couples can only petition for divorce if they can prove their marriage has irretrievably broken down and one of five facts of: adultery; behavior; 2 years separation; 5 years separation; or desertion applies. Unless a couple is relying on separation, an element of blame must be put on one party to the divorce. This can add unnecessary animosity and costs to an already difficult situation. Under new legislation, the fault elements will be removed. A welcome change for many.
